Many drug cases arise from searches which occur after a traffic stop, or a "stop and frisk." These cases call into question whether there was probable cause for the police to make the stop, and whether there was an illegal search and seizure. Wigell & Associates aggressively defend these cases by filing motions with the Court asking to have the drugs suppressed or excluded from trial. When the judge grants our motion, the prosecutor cannot go forward with the case, and has no choice but to dismiss the charges. In many other situations, the people who contact our law firm about drug charges are not the offenders. They are family members who are looking for a way to help their loved one because he or she has an addiction problem.
Our job as drug law attorneys is to refocus the court's view from punishment to rehabilitation. Drug charges are very serious. There are very few misdemeanor drug charges, most involving very small amounts of marijuana. Almost all other drug charges are felony offenses. Conviction of a felony means the offender will spend at least a year in jail if found guilty, and often much longer. A felony conviction can also ruin your prospects for future employment.

Just because you or your loved one has been arrested and charged with a drug crime does not mean that the police followed all of the proper procedures. A policeman can't stop someone unless they have probable cause. Police need either a search warrant or a compelling reason to search your car or your home. Our drug law attorneys are often able to exclude evidence and obtain dismissals of drug charges because police didn't have a good reason to stop the person's car or go into the person's home.
